I have always wondered why this is so hard.

    1. Only issue valid driver’s licenses to those who are legally in the United States.

    2. If you get stopped driving without a valid driver’s permit, your legal status should be checked.

    3. If you are in the country illegally, you get turned over to ICE.

Please note – if I get stopped and don’t have my driver’s license with me then the police should verify my legal residence in the US. If you are are a blue eyed, blond haired Dane who is in the country illegally, you get handed over to ICE.

Employers should also be forced to use e-Verify with very serious penalties for failing to do so.

These actions are neither racist nor hard to take. However, simple steps seem to always be out of reach on this issue.

I have the distinct impression that both sides of the political spectrum have both an “official position” and a real position on these matters.

  2. The United States Supreme Court stated in Plyler v. Doe (1982), as follows.
“Although the State has no direct interest in controlling entry into this country, that interest being one reserved by the Constitution to the Federal Government, unchecked unlawful migration might impair the State’s economy generally, or the State’s ability to provide some important service. Despite the exclusive federal control of this Nation’s borders, we cannot conclude that the States are without power to deter the influx of persons entering the United States against federal law, and whose numbers might have a discernible impact on traditional state concerns.”

    Yes,
I have also wondered why this is so hard.
America has historically allowed in people from many backgrounds while throwing up restrictions. Some of them are mindless and bureaucratic. I don’t know if you have dealt with INS or ICE but I have.
Secondly, The New York Times reports this morning that the number of illegals in the U.S. from Mexico has dropped dramatically since 2005. They apparently can’t find work, are frustrated by the Tea Party types or the birthrate in Mexico is dropping. So, we’re running around passing restrictive and ugly laws for a problem that is diminishing itself.
Lastly, what is so hard to understand is that the beauty of our legal system, which is designed to protect minorities as opposed to the majority.
Running around checking everyone’s driver’s license really misses the point.
