In Defense of Painful Free Speech

The horrific attacks of October 7th on Jews in Israel have prompted pro-Palestinian groups, including several at UVA, to rally in support of Hamas. In recent days, we have heard growing calls for support of Palestinians and condemnation of Israel as the Israeli Defense Forces and Iran’s proxies – Hamas, Hezbollah, Islamic Jihad, and Ansar Allah (the Houthi movement in Yemen) wage the most significant war in and around Israel in years. This is a war precipitated solely by Hamas’ surprise terror attack of unprecedented scale and proportion on unarmed Israeli civilians.

A common theme across the statements of pro-Palestinian groups and many university administrators and faculty is an explicit or implicit assertion of some moral equivalence between the suffering of human shields in Gaza and the victims of barbaric terror attacks in Israel. The linguistic turn that Hamas’ apologists employ most commonly is the ‘yes, but…’ device.

Some responded to these abhorrent statements with calls to restrict free speech, to sanction the terrorists’ enablers formally, and to quell somehow this pruriently hateful speech. I disagree. Most vehemently. Let the antisemites have their say. Why? Because now we know with certainty what they believe and how they genuinely feel about others in our community.

The downside of strict censorship is uncertainty about peoples’ actual beliefs. For example, by making the use of the n-word utterly forbidden, we protect the sensibilities of Black people who would suffer, at a minimum, great offense and possibly some genuine harm. However, the cost of that protection is that it enhances the ability of the faithful or casual racists to hide in our midst. Continue reading

In Higher-Ed, Diversity = Affirmative Action

A couple of years ago, in a conversation with another dean at the University of Virginia, I was asked about my views on the ever-expanding Diversity, Equity, and Inclusion enterprise. I explained that I was not a fan of the diversity movement and affirmative action. When asked why, I explained that my preference was for merit, and merit alone, to determine the allocation of scarce resources and in particular, admissions and employment spots. The conversation then turned to what the effects might be of basing admissions decisions solely on merit.

“Would you be OK with the student body being 40% Asian?” I was asked.

“Of course,” I responded. “But if you feel that UVA, as a public institution, should have a student body that represents Virginia’s population, then be explicit about that, and adopt quotas. I wouldn’t be happy with that, but at least we wouldn’t be hypocrites.”

My partner in the conversation, being of a legal mind, then observed, “You know we can’t do that, adopt quotas. Quotas are illegal.” And therein lies the rub.

Diversity, as practiced in American higher education, in general, and at the University of Virginia in particular, is a fraud. The word ‘diversity’ is a linguistic dodge to enable universities to sidestep what lawyers refer to as ‘strict scrutiny’ of the legality of affirmative action. Affirmative action, as a term, is a euphemism for race-based discrimination. So, Diversity is a double dodge. Continue reading

Diversity Statements Snuff Out Academic Freedom

Why should you care about faculty review policies at the University of Virginia and other public Virginia universities? You should care because they affect which faculty are likely to stay at a university and which faculty are likely to move on. In other words, they affect who will teach your children and grandchildren. 

You should want universities to keep professors who conduct state-of-the-art research and excel at teaching their scholarly discipline. But that’s not what you’re going to get with the new guidelines issued by the UVa College and Graduate School of Arts & Sciences. (See the previous post.)

Pay raises and the annual reviews that affect them are powerful administrative tools that universities use to incentivize faculty efforts. Given that there are only so many hours in a day, faculty allocate their time towards areas that their employers reward and away from those that they do not. Continue reading
